  1. This is a legally binding agreement between you and KERF hospital establishing the terms and conditions under which the Kerf website may be used. Use of the Kerf website implies that you accept these Terms and Conditions.
  2. SERVICE DESCRIPTION:
    • Clinical laboratory services are tests, which are usually done on clinical specimens in order to obtain information about the health of a patient as pertaining to the diagnosis, treatment, and prevention of disease. Tests results should be interpreted by a qualified medical doctor.
    • Some tests and packages are conducted as a screening procedure only and are not to be taken as a medical advice by Kerf Hospital or its affiliate members.
    • The health packages available on the Site cannot be split between two or more people and is non-transferrable, unless approved by Kerf staff, in writing.
    • If more than 1 package / products selected, include a GP / Speciality Doctor Consultation in both or all packages / products, the Consultation service can be availed only once.
    • The soft copy of your medical reports, received from the service providers, will be made accessible to you electronically through online / email / etc. reporting facility available on our website
  3. LIMITED LICENSE:
    • You are granted a limited, non-exclusive, revocable and non-transferable license to utilize and access the Site pursuant to the requirements and restrictions of these Terms of Use.
    • Kerf Hospital may change, suspend, or discontinue any aspect of the Site at any time.
    • Kerf Hospital may also, without notice or liability, impose limits on certain features and services or restrict your access to all or portions of the Site.
    • You shall have no rights to the proprietary software and related documentation, if any, provided to you in order to access the Site.
    • Except as provided in the Terms of Use, you shall have no right to directly or indirectly, own, use, loan, sell, rent, lease, license, sublicense, assign, copy, translate, modify, adapt, improve, or create any new or derivative works from, or display, distribute, perform, or in any way exploit the Site, or any of its contents (including software) in whole or in part.
  4. PERMITTED USE:
    • You agree that you are only authorized to visit, view and to retain a copy of pages of this Site for your own personal use, that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than for personal use, unless otherwise specifically authorized by Kerf Hospital to do so.
    • You also agree not to deep-link to the site for any purpose, unless specifically authorized by Kerf Hospital to do so. The content and software on this Site is the property of Kerf Hospital.
    • The cardholder must retain a copy of transaction records and Merchant policies and rules.
  5. MODIFICATION:
    • Kerf Hospital reserves the right in its discretion to change without prior warning or notice any information or material contained on the Kerf Hospitalwebsite and these terms and conditions under which the Kerf Hospital website is used.
  6. COPYRIGHT AND INTELLECTUAL PROPERTY RIGHTS:
    • All rights reserved, Copyright in the text, images, photographs, graphics, layout and design of this site are protected by Indian Federal Law regarding Copyright and Related Rights and international copyright laws. Copyright in this site, and in the code, text, images, photographs, graphics, layout and design of this site, and other copyright works contained in this site, is owned by Kerf Hospital, or used with permission. No part of this publication may be reproduced in any form without the written permission of Kerf Hospital.
    • Furthermore, Kerf Hospital may terminate the privileges of any user who uses this Site to unlawfully transmit copyrighted material without a license, express consent, valid defence or fair use exemption to do so. If you submit information to this Site, you warrant that the information does not infringe the copyrights or other rights of third parties.
    • Kerf Hospital is not responsible for the content, quality or accuracy of data provided by users, compilations of such data, text, information and other materials made available to users through Kerf Hospital’s system.
    • The On-line Materials are Kerf Hospital’s intellectual property, and are protected by Indian and international intellectual property laws. The On-line Materials may not be copied or redistributed either in whole or in part without prior written consent of Kerf Hospital, except as expressly and specifically permitted under these Terms of Use.
    • The Online Materials are and will remain the exclusive property of Kerf Hospital.
    • All rights, titles and interests in and to the Online Materials will be and remain vested solely in Kerf Hospital.
    • Under no circumstances will you have any right, directly or indirectly, to own, use, copy, loan, sell, rent, lease, license, sublicense, redistribute, assign or otherwise convey the On- line Materials, or any rights thereto, except as expressly and specifically provided in the Terms of Use.
    • Nothing in these Terms of Use will convey to you any right, title or interest, except that of a license with the express rights and subject to all limitations herein.
    • Nothing in these Terms of Use grants you the right, directly or indirectly, to use the On-line Materials to create a product for resale or to use the On-line Materials in any way that competes with Kerf Hospital.
    • You acknowledge and agree that Kerf Hospital will own all rights, titles and interests in and to any copy, translation, modification, adaptation, derivative work or improvement of the On- line Materials made by or for you.
    • By providing materials to Kerf Hospital, including by submitting or uploading content or materials for use on the Site you represent and warrant that you or the owner of all rights to such content or materials has expressly granted Kerf Hospital an irrevocable world-wide right in all languages and in perpetuity to use and exploit all or any part of the content and materials provided by you.
    • Kerf Hospital may publish and distribute any such submitted content or materials at its sole discretion by any method now existing or later developed.
    • You agree that you shall waive all claims and have no recourse against Kerf Hospital for any alleged or actual infringement or misappropriation of any proprietary rights in any communication, content or material submitted to Kerf Hospital.
    • Any communication or materials you send to Kerf Hospital will be treated as non- confidential and non-proprietary and may be disseminated or used by Kerf Hospital for any purpose, including, but not limited to, developing, creating, manufacturing or marketing products or services.
    • You may not use Kerf Hospital’s name, logo, trademarks or brands without the Kerf Hospital’s express permission.
    • At Kerf Hospital ’s request, you must execute, or obtain the execution of, any instrument that may be necessary to assign these rights, titles or interests to Kerf Hospital or perfect these rights, titles or interests in Kerf Hospital’s name.
  7. CONFIDENTIALITY:
    • During the course of using of Kerf Hospital website and/or App, you will be entrusted with confidential and proprietary information. You agree that no such information will be released or disseminated whether directly or indirectly, unless authorized by the Company Management, required by laws of India, or through the express written consent of the in charge who has the authority to give such consent.
    • “Confidential Information” shall mean any information disclosed by Kerf Hospital to the Customer, either orally or in writing (including electronically or by any other means), either directly or indirectly.
    • The Customer agrees to keep the existence and nature of this confidential information and not to use the same in any publicity, advertisement, or other disclosure with regard to the confidential information without the prior written consent of the Kerf Hospital’s management.
    • The Customer shall keep confidential, all information including without limitation; processes, procedures, prices costs, business affairs, financial, accounting, legal, data, personal, concepts, records, programs, reports, and administrative information, including any information about intellectual property rights, customers, clients, employees, products, any notes, analyses, services, trade secrets, software, or any information of a technical, Legal, commercial or financial nature; names, addresses, any other information that is identified as being of a confidential or proprietary nature, regardless of whether such information is communicated orally, in writing, pictorially, by electronic transmission or otherwise and any other information received during using Kerf Hospital site and/or APP (the “Confidential information”).
    • The Customer understands that all information relating to Kerf Hospital must be held in strict confidence, so as to guarantee the Hospital’s right to privacy and assure that information will not be disclosed for any unauthorised purposes.
    • The Customer will not use any of the confidential information supplied by the Kerf Hospital for its own gain or gain of any other person, organization, firm or corporation; he/she understands that failure to protect the confidential nature of the information would have a detrimental effect on, Kerf Hospital’s business endeavors.
    • The Customer recognizes and agrees that money damages will not be sufficient remedy for any breach or any breach or threatened breach will result in immediate and irreparable damage to the Kerf Hospital.
  8. CUSTOMER OBLIGATIONS AND UNDERTAKINGS:
    •  If you use Kerf Hospital Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your account from any devices, and you agree to accept responsibility for all activities that occur under your account or password.
    • The Site shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section.
  9. POLICY – ONLINE PAYMENT ON WEBSITE AND APP
    • The Website and App provide you the ability to pay online through a third-party payment gateway for some of the Services available on the Website or App.
    • If you choose to pay online, you may be directed to a third-party payment gateway to enable processing of the payment. This transaction will be governed by the terms and conditions and privacy policy of the third-party payment gateway.
    • Kerf Hospital shall not be liable:
      • if any transaction does not fructify or may not be completed or
      • for any failure on part of the bank or the credit card or the third-party site or agency to perform any of its obligations or
      • In respect of any loss or damage arising directly or indirectly arising out of the decline or acceptance of authorization for any transaction, for any reason whatsoever.
    • Kerf Hospital shall not be responsible in case communication is not received by the customer due to incomplete address given by the individual.
    • The signature in the application form will be taken as the customer’s specimen signature.
    • In case you avail of the services listed on Kerf Hospital and are, thereafter, not available on the contact details provided in the registration form, then the package / reservation selected by you will stand automatically cancelled and Kerf Hospital would not be liable for any charges/expenses incurred by you, either directly or indirectly in this regard.
    • An email will be sent to the customer from Kerf Hospital as payment confirmation
    • All other general terms and condition pertaining to the insurance policy of the member applies as appropriate.
    • Accepted All Credit and Debit Cards
    • On clicking “Make Payment”, your payment will be processed and on successful completion of the transaction, a Transaction ID will be provided to you. This is the confirmation id of your payment. Invoice for all paid OPD appointments would be generated 15 minutes before the appointment time. An email and/or SMS with invoice number would be sent to your email id and the mobile number given at the time of booking.
    • We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the present limit mutually agreed by us with our acquiring bank from time to time.
    • For international patients an email and SMS with invoice number and the consultation link would be sent to your email id and the mobile number given at the time of booking for you to join post the payment and appointment confirmation.
